Opposing the CBI’s application, senior advocate Rebecca John, who appeared for Nair, told the court it was an abuse of due process and that the FIR was politically motivated.

She said that at the time of registering the current case on August 17 and on August 19, when the CBI raided his home and Nair was not in India, the agency was unable to recall “any any articles or incriminating content”.

She said Nair had nothing to do with the implementation of alcohol policy and only took care of AAP’s media affairs. She added that the CBI had not accused Nair of being the beneficiary of any “illegal payments received by receiving commissions from alcohol producers or distributors”.
Meanwhile, the court also awarded eight days of detention for another defendant, alcohol businessman Sameer Mahendru, to the Department of Law Enforcement (ED) after the agency, through attorney NK Matta, sought 10 days in detention.
