‘Not giving these victims another chance with a jury that can sit there and consider all the evidence – win, lose or draw – would be an injustice.’

Judge Charlaine Olmedo denied the defense’s request to dismiss the case, after defense attorney Philip Cohen argued it was “unlikely” that any jury would reach a unanimous verdict.

He said: ‘Not the things that Mr. Mueller considered important or significant were left out.

‘Those were things that were discussed and were not thought to be important to decision-making for some jurors.’

But Judge Olmdeo ruled that Cohen’s arguments were ‘speculative and not substantiated by fact’.
